Selena Gomez Named in Million Dollar Lawsuit

Selena Gomez, Disney starlet and girlfriend of Justin Bieber, has been named in a million dollar lawsuit involving the chorus of her 2010 hit song “A Year Without Rain.”

Plaintiffs Tom Luce, Brian Kroll, Lawrence Riggs and Matt Blackett, of the band Luce, claim the tune is “virtually identical” to their 2005 song “Buy a Dog” which appeared on the group’s second album “Never Ending.”

Gomez, 19, who starred in the Disney Channel series, “The Wizards of Waverly Place,” performed the song with her band, Selena Gomez & The Scene, also named as a defendant in the case, which was filed in the San Francisco Superior Court.

Courthouse News Service reports the complaint states that "The melodies in the chorus of both songs are virtually identical," and that the tune "was a No. 1 record on several radio stations around the United States, including WRLT in Nashville and KFOG in San Francisco, at both of which it was among the 10 most played records for the entire year of 2005".

"A Year Without Rain" was also released as a single in Spanish (“Un Ano Sin Lluvia”).

Gomez made further headlines in February when she attended the Vanity Fair Oscar Party on the arm of Bieber, ending months of speculation over whether or not the pair are a couple.

In 2009, Gomez was appointed a UNICEF ambassador, making her the youngest ambassador for the charity in the United States.

Gomez’ reps have yet to comment on the lawsuit.

Band Claims They Wrote Selena's Hit Song

Four songwriters claim in court that the Selena Gomez and her publishers owe their band $1 million because the chorus in Gomez's 2010 hit, "A Year Without Rain" is "virtually identical" to their 2005 song, "Buy a Dog."

Plaintiffs Tom Luce, Brian Kroll, Matt Blackett and Lawrence Riggs, of the band "Luce," claim the tune appeared on their second album "Never Ending."

Gomez's song was a worldwide hit and was released as a single in Spanish (Un Año Sin Lluvia) after Gomez's band, Selena Gomez and The Scene, performed it in 2010.
The Scene, also named as a defendant, claimed the song was written by co-defendants Lindy Robbins and Toby Gad.

"The melodies in the chorus of both songs are virtually identical," the complaint states. Luce claims that its tune "was a No. 1 record on several radio stations around the United States, including WRLT in Nashville and KFOG in San Francisco, at both of which it was among the 10 most played records for the entire year of 2005". They claim it was played more than 4,000 on Sirius/XM radio.

"Defendants continue to infringe plaintiffs' copyright by, among other things, creating and distributing phonorecords in various formats, including but not limited to compact discs and digital downloads, embodying or incorporating performances of the infringing work," the complaint states. "At no time have the plaintiffs authorized defendants, or any of them, to republish, perform, create derivative works based on or otherwise exploit all or any portion of their song."

The Luce members are represented by Nicholas Carlin, with Phillips, Erlewine & Given.

Complaints such as this are difficult to win. One musicologist, who has testified in copyright lawsuits, pointed out that the first four notes of "How Dry I Am" have been used in "hundreds" of compositions.

Selena Gomez opens up about Spanish 'Year Without Rain'

Late last month, Disney Channel star Selena Gomez presented a new version of her hit "A Year Without Rain," one that was encorded entirely in the Spanish language. It was a bit of a shake-up for the 18-year old star, who has to this point recorded in entirely one language in spite of her Mexican heritage.

In a new video from Terra (which you can see to the left), Gomez talks a bit about her recording of the Spanish-language version of her hit song, which she says was a bit nerve-wrecking at first. She wanted to make sure she "pronounced" everything correctly, which she also said recently on "Lopez Tonight" was one of her fears about performing an album entirely in Spanish. She has expressed a desire to do so at some point in her career.

Also in the video, Selena opens up about how her father chose to name her after the legendary Latin star Selena Quintanilla-Pérez who passed away at a young age (whose life later became a breakout role for Jennifer Lopez). Since Selena has listened to the entire back catalog of her namesake, she claims to have even more of a desire to touch some her fans with Latin roots.

Even if you do not speak Spanish, do you nonetheless enjoy Selena's Latin version of her hit song?

Video Premiere: Selena Gomez's 'Un Ano Sin Lluvia'

"Un Ano Sin Lluvia", a Spanish version of Selena Gomez's single "A Year Without Rain", has got an accompanying music video. It still features same scenes from previous clip for the English version about a girl who is longing for the guy she loves. The only new footage is the one which features her singing the Spanish lyrics.

The new scene seeing her dressing in a Catherine Dean gray chiffon halter gown was filmed earlier this month. "So weird to be back in this dress..... Spanish version," she tweeted. The "Wizards of Waverly Place" star has put the outfit on charity auction which reportedly ran until November 10.

The money will benefit UNICEF, a foundation where Selena is an ambassador for. "It's a beautiful dress. It was obviously a very important part of the video - we wanted it to be very beautiful and very flowy and I got so many great comments on it so I thought it would be awesome to give it to charity," she said.

"A Year Without Rain" is taken from an album of the same name. Making its way out in September, "A Year Without Rain" is Selena Gomez's second studio album with The Scene and it peaked at No. 4 on Billboard Hot 200.

Selena Gomez and The Scene hang out backstage before their performance on Lopez Tonight on Tuesday night (November 16).

The band had a stellar performance on the show, singing “A Year Without Rain” in Spanish. Check it out below!

Selena also shared with host George Lopez about one day recording a whole album in Spanish: “I have her album, and exactly what she [Shakira] did is my dream. I feel that, for my family, it would make them really proud but since I’m doing so many things, I can’t really sit down in the studio; I want to perfect it. I would want my dad to come out and make sure I’m doing it right. I want to take my time with it.”

Sing With Selena Gomez and The Scene's Un Año Sin Lluvia!

Un Año Sin Lluvia

di que sientes
cuando pienso en ti
una y otra vez

cada instante
que no estas junto a mi
mi mundo esta al reves

camino en un desierto
cuanto tu te vas oooh
no se si es un espejismo
te siento tan real.
baby

quiero volverte a ver
para calmar mi sed
un dia sin ti
es como un año sin ver llover
si escapas otra vez
no sobrevivire
un dia sin ti
es como un año sin ver llover

contando estrellas
oigo en mi mente tu voz
os tu la mia?
mi corazon esta sufriendo
la soledad
soy un desorden
camino en hojas secas
si no estas aqui
y mi vida

regresa que yo un diluvio
llorare por ti

baby

quiero volverte a ver
para calmar mi sed
un dia sin ti
es como un año sin ver llover
si escapas otra vez
no sobrevivire
un dia sin ti
es como un año sin ver llover

regresa aqui
abrazame
soy un desierto
sin tu querer
vuelve pronto a mi
no seas asi
porque un dia sin ti es como
un año sin ver llover

quiero volverte a ver
para calmar mi sed
un dia sin ti
es como un año sin ver llover
si escapas otra vez
no sovrevivire
un dia sin ti
es como un año sin ver llover

Selena Gomez 'Had To Fight' To Get Katy Perry Song 'Rock God'

Selena Gomez had many rumored contributors to her A Year Without Rain album, including reported cameos from Miley Cyrus and Demi Lovato. But of all the ladies rumored to be involved, "California Gurls" singer Katy Perry was the only one who actually showed up.

Gomez said she had to fight tooth and nail to make Perry's cameo happen.

"Katy Perry gave me a song called 'Rock God.' It's one of my favorite songs ever," she told MTV News. "I actually had to fight for that song. I wanted it so bad. It's kind of funky, and I think I used her style and we kind of mixed it up with the producers that I worked with with my style, so we made it a little bit more techno."

Not only did Perry lend her the song, she also lent Gomez vocals on the track. "I just loved her style, and she did background vocals on that as well," she recalled. "So I was very, very blessed on the record, 'cause it's so much fun, and I can't wait to perform it."

How did the Disney princess and the pop star end up working together? "We actually have the same music agent, so whenever she'd have concerts and stuff, I'm a huge fan, so I definitely would go to most of her shows. And I've seen her at a couple of events, so I've talked to her," Gomez explained. "But when it came to music, I didn't want to get in personally. I was like, 'I'll ask through the proper channels and see if she'll give it to me,' and she was thrilled, so I was happy."

Selena Gomez On Taylor Swift's Speak Now: 'People Are Gonna Be Surprised!'

In addition to "Glee" returning, there's another big release: Selena Gomez's new album, A Year Without Rain. And, as it is with most industries, there's no better person to give their impression of your work than one of your peers.

Fortunately for Selena, that person is her good friend Taylor Swift, who also has a new album, Speak Now, set for release in October. Taylor has already picked out her favorites from Selena's tracks, preferring "Rock God" and "Ghost of You" to the already-released track "Round & Round."

"She heard [A Year Without Rain], and it's so funny 'cause she's very passionate, and she's very dramatic—which I think is why we're friends because we're both dramatic—but she has her favorites already," said Selena. "But she definitely danced and had her little thing. She's completely honest with me, so it was nice to have her feedback."

Taylor was nice enough to return the favor and let Selena sneak a listen to Speak Now. Selena's picked her favorite tracks as well—"Dear John" and the unnamed track 13—adding that she's excited for the upcoming record because it's "amazing."

"Her album is going to be awesome. I think people are gonna be really surprised. It's not different [but] you just don't really believe she could top it, in a way," she explained. "She took her style and made it bigger. It's going to be really good."

Which album are you more looking forward to: Selena's or Taylor's?

Will Demi Lovato Be On Selena Gomez's Album?

With so much talk that Selena Gomez's fellow Disney princess "Sonny With a Chance" star Demi Lovato may make an appearance on her forthcoming album, A Year Without Rain, fans of both the "Wizards of Waverly Place" star and the "Camp Rock 2" star may have been hoping that the two songstresses would get together for some funky pop-music collaboration.

So when MTV News caught up with Demi Lovato on Wednesday night at the "Camp Rock 2: The Final Jam" premiere in New York City, we wanted to know if there was any truth to those rumors.

"No! It's not true," Lovato shared about the album, which is also said to have songs featuring Katy Perry and Miley Cyrus. "I think she's already finished with her album."

However, she didn't totally rule out ever working with Gomez, especially given that she's hard at work on her own album. "I don't know," she said about a possible collaboration.

Whether or not a Gomez-Lovato partnership does ever happen, she's still focused on her wish list of having Drake and Trey Songz on her new record. And she's looking forward to using her big voice on the R&B-influenced album.

"It's really nice to embrace it," she said. "I grew up singing R&B and then I grew up listening to rock, so it was kind of weird. But I'm kind of learning how to incorporate the two and I'm having a good time with it. ... I can put my vocal stylings on songs that are R&B and it showcases my vocals more than just singing really loud on a rock song."

War of the Album Covers!

Taylor Swift unveiled her latest album cover on June 18 for Speak Now. Featured in a flowy purple dress and showing just the right amount of skin for a teen idol we have to say that Taylor got the look just right.

Unfortunately we can’t say the same for Selena Gomez (who just released the album cover for A Year Without Rain) and Miley Cyrus, whose album Can’t Be Tamed, has been shamefully sitting on shelves for months now. Here’s the problem: Miley’s album cover, featuring the teenager in a belly baring leather outfit with a cranky face was just too gross for her audience! But Selena’s sickenly sweet cover was simply too boring.

We think that Taylor got it just right. She showed some skin. She smiled (big points for a smile)! But she didn’t come off too boring or childish. It’s a fine line for these young starlets and singers to walk and it's good to know there’s a woman like Taylor out there to show them how to walk it.
